Nomi ("the Service") is operated by Otter and Pebble Studio LLC, a New York limited liability company ("we," "our," or "us"). These Terms of Service are an agreement between you and Otter and Pebble Studio LLC. By accessing and using the Service, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

Nomi is a baby name discovery application that provides:

• Name suggestions based on Social Security Administration data
• Automated name analysis and personalized recommendations
• Name trend analysis and cultural context
• Personalized name discovery based on your preferences
• Premium features for enhanced functionality

3. User Accounts

3.1 Registration

You must create an account to use certain features of the Service. You agree to:

• Provide accurate and complete registration information
• Maintain and update your information to keep it accurate

• Accept responsibility for all activities under your account

3.2 Account Termination

4.2 Payment Processing

Payments are processed securely through Stripe. By purchasing premium features, you agree to Stripe's Terms of Service and Privacy Policy.

4.3 Subscription Terms

Premium subscriptions:

• Automatically renew monthly unless cancelled
• Can be cancelled at any time through your account settings
• Remain active until the end of the current billing period after cancellation
• Are non-transferable

4.4 Promotional Codes

Promotional codes may be provided at our discretion. These codes:

• Have expiration dates and usage limits
• Cannot be combined with other offers unless specified
• Can be revoked or modified without notice
• Are non-transferable

4.5 Refund Policy

Subscription fees are charged on a monthly basis. You may cancel your subscription at any time to prevent future charges. Refunds for the current billing period may be considered on a case-by-case basis within 7 days of payment for technical issues that prevent service usage. Name popularity data is sourced from the U.S. Social Security Administration (public domain). Cultural context and analysis are generated automatically by language models.

6.3 Your Content

You retain ownership of any data you create in the Service (favorites, preferences, etc.). By using the Service, you grant us a license to use this data to provide and improve the Service.

7. Automated Features & Limitations

Our automated features provide suggestions and analysis based on algorithms and data. You acknowledge that:

• Recommendations are suggestions only, not professional advice
• Cultural context may not cover all cultural perspectives
• Name meanings and origins are based on available historical data
• Popularity trends are based on past data and may not predict future trends
• Free tier users are limited to 5 insight feature calls

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free service

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OTTER AND PEBBLE STUDIO LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers
• Any bugs, viruses, or similar transmitted to or through the Service
• Any errors or omissions in content
• Any conduct or content of third parties

Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim, or $100, whichever is greater.
